Legal

By commissioning me, you confirm that you have read and understand these terms of service and agree with them.To commission me, you must at least be over the age of 18.In the event of legal disputes, they will be settled according to German jurisdiction.

What you will receive

All my artwork is digital and you will typically (i.e. unless discussed otherwise) receive files as outlined below. Please make sure that you backup your downloads properly, because the links or files that I send you may not be available eternally.Animations
A video file (.mp4), with my watermark. The video will have the original rendering resolution (usually 1080p) and will be encoded using AV1 at a perceptually lossless quality level.
Additional options upon request: Video file without watermark, without any post-processing, or the raw render images in an HDR format. Let me know during the commission process to discuss your use-case and options, which may incur a surcharge.Still Renders and 2D Artwork
Original resolution file without my watermark and lossless compression (.png). Please do not share this file.
A watermarked version of the file, which can be shared online.VRChat Avatars and Re-Textures
A package file (.unitypackage) of the assets that you can import into Unity. The avatar will have a VRChat performance rating of Medium unless discussed otherwise. Textures will be exported in a lossless format at the original resolution.
Please note that due to the way VRChat works, you need to be capable of uploading the avatar to VRChat yourself. Also, I cannot guarantee continuous support updates once a commission is finished. If an update of VRChat breaks the project, you might need to find solutions yourself. I will try to offer some guidance if necessary, to the best of my abilities and schedule.

Your rights

You retain all rights to your character(s). I will not use your character(s) or models of them beyond the scope of the commission without your permission.I will send you regular WIP images/videos. You can request me to change anything that you feel is wrong. I appreciate it if you redline the errors to better show me what you mean. I will attempt to fix all issues to the best of my abilities so that you are happy with the result. However, change requests must be within reason, and, especially for 3D models, please keep in mind that it's sometimes not possible to do significant adjustments late in the process.You are allowed to use my artwork for the following purposes:
    - Use and edit for personal or non-commercial purposes. For instance, you are allowed to:
        - Post images on social media.
        - Make texture alterations because your fursona has changed.
        - Make my 3D model compatible with some other animation tool or game engine.
        - Print the un-watermarked version of a 2D artwork via a printing service and hang it on your wall or create stickers.
    - Give my 3D models to another artist to carry out the work described in the previous bullet point.
    - Use it to promote yourself, e.g. use the model/avatar to make videos for your YouTube or TikTok channel, even if you do this work commercially.
    - When you do social media posts, I would be happy if you would also add a link to https://vonfluffington.art or one of my profiles, but doing so is not required.We are both prohibited from using the artwork for the following purposes without the consent of the other party:
    - Commercial purposes, e.g. for selling T-Shirts with the artwork.
    - Making 3D models available for others to download freely via websites such as Gumroad or publicly shared links.
    - Selling of derived works, e.g re-textures.
    - Use it or any derived works to:
        - Create non-fungible tokens (NFTs).
        - To train artificial intelligence (AI) or Machine Learning (ML) or use AI or ML to create derived works.I retain the right to:
    - Post work in progress (WIP) and the final artwork to social media and use it to promote my services. Private commissions are available at a 10% surcharge.

Won't Do

I do not accept commissions containing topics from the following list. This list is not intended to shame anyone's kinks.
    - Humans
    - Scat
    - Cub
    - Hyper
    - Obese charactersIf you have any doubts about whether or not I will do something that's not on this list, feel free to reach out and ask.

Payment

All payment will be handled via PayPal. I will send you an invoice at the moment I am ready to start working on your commission.All prices and payment is in Euro (EUR).Payment plans might be available depending on the scope of your commission, at no additional charge. Let me know during the commission process if you wish to discuss the options.

Cancellation

You can cancel the commission at any time without specifying a reason.If you cancel before I started working on your commission, you will not be invoiced.If you cancel after I started, you will receive a refund, reduced by an estimate of the work that I have already completed.
For instance, if I have already completed 20% of a commission when you cancel, you will receive a refund of 80% of your payment.I am allowed to cancel the commission at any time for any reason. In that case, you will receive a full refund, regardless of the amount of work that I have already completed.
